Article 1 - Scope and Modification of the General Conditions of Use

These general terms of use (“the GTU”) are concluded between MASAMUNE and any non-commercial natural person, or any legal entity not having the same field of activity as MASAMUNE (“the customer”), wishing to make a purchase on the website www.masamune-store.com (“the website”).
All orders placed through www.masamune-store.com are subject to these terms and conditions without reservation.
These represent the full reciprocal commitments between MASAMUNE and the user who becomes a customer of the company.
MASAMUNE reserves the right to adapt or modify these general terms and conditions of sale at any time, which will then be applicable as soon as they are posted online. In case of modification, the general conditions of sale in force on the day of the order will be applied to each order.

Article 2 - Access to the site and Customer Service

The customer is responsible for the implementation of the IT and telecommunications means allowing access to the website and customer service. The customer shall bear all telecommunication costs incurred when accessing and using the website.

Article 4 - Products

The products governed by these GTU are those that appear on the Website at the time of purchase and are indicated as sold and shipped by MASAMUNE (the «Products»). They are offered within the limits of available stocks. The essential characteristics of the Products are described and presented with the greatest possible accuracy.

Article 5 - Prices

The prices of the Products are indicated in Euros including all taxes. They take into account VAT and any reductions applicable on the day of the order.
The prices of the Products are exclusive of delivery costs (shipping, packaging and preparation of the package according to the amounts in force). The amount of delivery charges will be specified before validation of the order.
If one or more taxes or contributions, particularly environmental taxes, are created or modified, both in the increase and decrease, this change may be reflected on the sales price of the Products present on the Website and on the various sales media.
As regards the price of books, these are established in strict compliance with the law Lang 81-766 of 10 August 1981. In this context, MASAMUNE will be able to offer its clients the most attractive price allowed by law, a discount of up to 5% of the price of the work. This discount is always indicated on the product sheet. The VAT applied on printed books is 5% in application of article 278-0 bis A 3°) of the General Tax Code.
In the case of an order to a country other than metropolitan France, the customer is the importer of the product or products concerned and must therefore ensure that the import of the ordered product is in accordance with its local legislation.
For all products shipped to the DOM TOM and outside the European Union, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and amounts are not the responsibility of MASAMUNE. They will be the responsibility of the customer. The customer must inquire about these aspects, before any order at MASAMUNE or on its Website, with its local authorities.
In case of refusal of goods, the customs costs remain at the customer’s expense regardless of the possible reasons. The only major exception is a potential preparation error attributable to MASAMUNE. In this case, MASAMUNE undertakes to pay the customs fees for the second shipment. All orders, regardless of their origin, are payable in Euros.
MASAMUNE reserves the right to change its prices at any time. However, the products will be invoiced on the basis of the rates in force at the time of registration of orders. However, in the event of a price error (price clearly negligible compared to the real value of the product), the validated order may be cancelled by MASAMUNE. This is still an exceptional measure.

Article 6 - Order

The command is organized in several steps which can be summarized as follows:

  • Customer adds one or more products to their cart;
  • The customer creates an account on the site to fill in his status (individual, association, company) and his contact details;
  • The customer is then asked to choose a delivery method, the terms and conditions of which are automatically set by the site according to the products in the cart and the desired delivery address;
  • The customer makes his payment, either online (via Banque Populaire or Paypal) or offline by sending a cheque or making a transfer;
  • The customer receives an email confirming his order and then confirming his payment.

a. Prior identification
To place an order, you must log in with your email address or customer number, and password. For your first order, you will need to create an account.

b. Order Registration and Validation
You have the possibility to place your order online. Once your basket is validated, you will have to choose the address and delivery method, and validate your payment method, this last step formalizing the sales contract with MASAMUNE.
Any order constitutes acceptance of the prices and descriptions of the Products available for sale. MASAMUNE will acknowledge receipt of your order upon its validation by sending you an email in which you will find a link to these General Terms and Conditions.
This email constitutes a contract concluded in electronic form between the Customer, identified by his account and IP number, and MASAMUNE. This contract meets the conditions of article 1366 of the French Civil Code.
The buyer declares to have read and accepted these General Terms and Conditions of Sale before placing his order. The validation of your order is therefore an acceptance of these General Terms and Conditions. From the moment the buyer has registered his order by clicking on the icon " Validate your order ", he is considered to have accepted in full knowledge of the facts and without reservation these General Conditions of Sale, the prices, volumes and quantities of the products offered for sale and ordered. Unless otherwise proven, the data recorded by MASAMUNE constitutes proof of all transactions made by MASAMUNE and its customers.
In some cases, such as for non-payment, wrong address or any other problem related to your account, MASAMUNE reserves the right to block your order until the problem is resolved.
In case of unavailability of a Product ordered, you will be informed by e-mail. The cancellation of the order for this Product and its possible refund will then be made, the rest of the order remaining firm and final.

The Client is advised to keep the transaction information on a paper or computer document.

Article 7 - Modalités de Paiement

Vous pouvez régler votre commande en utilisant l’un des différents modes suivant :

    • Par carte bancaire : Le paiement s'effectue sur les serveurs bancaires sécurisés de notre banque partenaire (Banque Populaire). Ceci implique qu'aucune information bancaire vous concernant ne transite via le site internet de MASAMUNE. Le paiement par carte bancaire est donc protégé par le système de sécurisation de notre banque partenaire ; votre commande sera ainsi enregistrée et validée dès l'acceptation du paiement par la banque que vous aurez choisie. Sécurisation Les coordonnées de votre carte de crédit sont cryptées grâce au protocole SSL (Secure Socket Layer) et ne transitent jamais en clair sur le réseau. L'ensemble des procédés de brouillage et de cryptage a aussi été renforcé pour protéger le plus efficacement possible toutes les données sensibles liées aux moyens de paiement. Le paiement est directement effectué auprès de la banque. MASAMUNE n'a en aucun cas accès à ces coordonnées, et ne les garde pas sur ses serveurs. C'est pourquoi elles vous sont redemandées à chaque nouvelle transaction sur notre site.

    • By bank cheque:
      Payment is made by post to MASAMUNE and to the following address: Masamune, 11 Rue Henri Régnault 75014 Paris, France.
      Your order is then reserved for 7 days. Beyond this time, without receipt of your cheque, it will be cancelled. The order will be processed only upon receipt of your cheque and after validation by our services.

    • By bank transfer: Payment is made by bank transfer to MASAMUNE, and whose IBAN details are displayed on the screen before the validation of the order through its bank account. The customer agrees to validate the transfer with their banking services. The order will be processed only after receipt of your transfer to our bank account and after validation by our services.

    • By PayPal payment: The payment by PayPal automatically redirects you to your PayPal account. Once the PayPal payment is validated, you can complete and validate your order. The order will be processed only after the information by PayPal of the validation of the payment on our account and after validation by our services.

The customer guarantees to MASAMUNE that he has the necessary authorizations to use the payment method chosen by him, when validating the order.
MASAMUNE reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in case of non-payment of any sum that would be due by the customer, or in case of payment incident.
Penalties equal to the legal interest rate plus five points are automatically applicable to amounts not paid at the end of a period of ten days following the date of invoicing or upon notification of the bank payment rejection for any other means of payment. The delivery of any new order may be suspended in case of late payment of a previous order and this notwithstanding the provisions of these.
MASAMUNE reserves the right to request a photocopy of the customer’s identity card for any payment by credit card or cheque.
After the payment confirmation by our services, the customer receives an email validating the order by our services. The customer will find in his account, under the order history/ details of the order concerned, the link to a file in pdf format of his invoice, which contains all the essential elements of the contract concluded between MASAMUNE and the Customer, and meets, with these GTC, the requirements of Article L.221-9 of the Consumer Code.

Article 8 - Retention of Title

The products remain the property of MASAMUNE until the complete collection of the order by MASAMUNE. However, from the time the customer receives the order, the risk of the delivered goods is transferred to the customer.

Article 9 - Fraud Control

These controls are intended to protect MASAMUNE from abusive practices by fraudsters.
For an order that has a delivery address different from the billing address, our services may contact the two persons mentioned; the person associated with the billing address and the person indicated for the delivery address.
As part of these procedures, our services may ask you for all the necessary parts to unblock your order: proof of address and debit in your name, but also proof of domicile in the name of the person indicated for the delivery address etc... These requests are made by email and then by mail with AR.

Article 10 - Delivery Terms and Delivery Times

  • General
    The products are delivered to the delivery address you provided during the order process.
    The products purchased on the Website are available in all countries indicated on the menu when ordering.
    The announced deadlines are indicated at the departure of our warehouses and are between 5 and 10 weeks from the validation of the order by our services.
  • 10.1 - Shipping times
    Advertised delivery times are calculated in business days (Monday to Friday).
    The times indicated are average usual times and correspond to the processing, preparation and shipping times of your order. They run from the validation of the order by our services.
    In case of payment by cheque, the order will be validated only upon its receipt. The shipping time shall not begin to apply until receipt of the goods. Article 7 applies.
    In case of delay, an email will be sent to you. To this time limit, the delivery time of the carrier (Post/ Carrier/ Chronopost) must be added, as well as customs processing.
  • 10.2 - Multiple Product Order
    For a multi-product order, the shipping time for this order is based on the longest shipping time. MASAMUNE reserves the right to divide the order into several deliveries, without any additional cost for the customer.
    Orders that are shipped from our stocks and orders that require specific production (especially for customized products, which are produced on order) can be considered as separate, both in terms of orders and delivery times. For this purpose, if the customer orders one or more products falling into these different categories, it will be issued an appropriate invoice for each product or group of products that are considered to be part of the same order.
  • 10.3 - Delivery times
    The products ordered are delivered by the postal system or by an independent carrier, depending on the nature of the product ordered and at MASAMUNE’s sole initiative, to the address indicated by the Customer on the purchase order form. The announced deadlines are indicated at the departure of our warehouses and are between 3 and 5 weeks from the validation of the order.
    The choice of delivery method depends on the weight, volume and value of the items.
    MASAMUNE cannot be held responsible for the consequences of a delay in delivery. Delivery methods If the order to be shipped by Chronopost requires several packages, we only charge once the shipping costs. It is the customer’s responsibility to choose the delivery mode from among the different modes available when ordering (Distingo, Chronopost...).
  • 10.4 - Orders Japan
    Custom products or Order Japan (for products that are not in store stock), are manufactured on request by our suppliers before being sent to us in our store.
    They are then checked before being sent or removed to you in store by you.
    Japanese suppliers now have a production lead time of 60 to 120 days.

Article 11 - Responsibilities

• MASAMUNE shall not be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure and in particular in the case of a total or partial strike by postal services, carriers, and disasters caused by floods or fires. With respect to products purchased for business purposes, MASAMUNE will not be liable for any consequential damages arising from this, loss of operation, loss of profit, damage or expenses that may arise.

• The selection and purchase of a product or service is the sole responsibility of the customer. The total or partial impossibility to use the products, in particular because of incompatibility of the material, may not give rise to any compensation, refund or liability for MASAMUNE, except in the case of a proven hidden defect of article 12 of these GTC, non-conformity, defect or exercise of the right of withdrawal referred to in article 14 of these GTC.

• Sale of martial arts training weapons is prohibited to minors (under 18 years in France. MASAMUNE reserves the right to request a legally recognized document (CNI or Passport) that allows us to determine the age of the customer.

Article 12 - Hidden Defects Warranty

If the products delivered by MASAMUNE have a hidden defect, MASAMUNE may, at its option, eliminate this defect or replace the product with another. If MASAMUNE does not wish to remove this defect or replace the defective good, or if MASAMUNE is unable to do so, or if MASAMUNE cannot do so within the time limit due to factors that are not dependent on its will or its own doing, the buyer may, at his option, return the products to him against reimbursement of the price and costs of return, or ask for a reduction in the sale price.
The products offered comply with current French legislation. MASAMUNE declines any responsibility in the event that the delivered product does not comply with the legislation of the country of delivery (censorship, prohibition of an author or a book). Likewise, its liability cannot be held for the content of sites to which hyperlinks may refer from its site. MASAMUNE is committed to providing all the care and attention required in the profession for the implementation of the service offered to the client.
However, its liability may not be held liable in the event of a breach of its contractual obligations due to an unforeseeable event or a case of force majeure such as, without limitation, natural disasters, strikes, fires, floods, failure or breakdown of equipment, means of transport, communication or due to the actions of the customer.

Article 13 - Processing of Parcels not distributed by the provider

These are packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage, plunder...

  • 13.1 - Returns under the NPAI pattern
    • Definition:
      These are the packages returned by the delivery service provider under the label: Does not live at the address indicated.
    • Processing of a NPAI return:
      After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wish, we will offer to return the product originally ordered or an exchange product with equivalent characteristics. The shipping costs for this new shipment are then at the customer’s expense.
      If you do not, a credit of the amount of the products contained in the package will be granted to you, excluding any other compensation.
  • 13.2 - Returns under the “unclaimed” reason
    • Definition These are the parcels that have not been claimed by customers at the post office within the deadlines set by the carrier (La Poste, Distingo, Chronopost...).
    • Processing of a return under the reason «unclaimed»
      After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wish, we will offer to return the product originally ordered or an exchange product with equivalent characteristics. The shipping costs for this new shipment are then at the customer’s expense.
      If you do not, a credit of the amount of the products contained in the package will be granted to you, excluding any other compensation.
  • 13.3 – Returns under the “refused” reason
    • Definition
      These are the packages that you refused at the time of delivery, regardless of the reason or even without a reason. Whatever the reason for refusal of the package by the customer, the latter is required to fill out the «Return & Withdrawal Form» available on the Website, and send it back to Customer Service within 48 hours.

    • Processing of a return under the “refused” reason
      You refused the package at the time of delivery. You must contact the customer service of Masamune within a maximum of 48 hours from the refusal.
      After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wish, we will offer to return the product originally ordered or an exchange product with equivalent characteristics.
      If not, a credit of the amount of the products contained in the package will be granted to you, excluding any other compensation.

      If your product is really damaged during transport, you must imperatively express reservations to the carrier and contact the Customer Service within 48 hours from receipt of the package.
      Depending on the nature of the product, available stocks and according to your wish, we will propose you to return the product originally ordered or an exchange product with equivalent characteristics.
      If you do not receive your parcel, a credit will be issued within 48 hours of the receipt by our services. It will correspond to the amount of the entire package (product(s) + shipping).
      If you have chosen to be refunded, a payment, which will be made according to the original method of payment, for the amount of the entire package (product(s) + shipping costs) will be sent to you within 30 days after acceptance of your package return by our services.
      The customer who has chosen the basic shipping rate (without signature, without insurance) and who refuses the package without reason, assumes the risks related to the transport of the package, both in the initial shipment and for the return shipment to MASAMUNE.

Article 14 - Right of Withdrawal

Pursuant to article L.221-18 of the French Consumer Code, the customer has a period of fourteen (14) days from receipt of the order to exercise his right of withdrawal. The right of withdrawal is expressed by the customer by filling in the «Return & Withdrawal Form» available on the Website. The Customer is informed that, pursuant to article L.221-8 of the French Consumer Code, the right of withdrawal cannot be exercised for orders concerning the following articles:

  • Unsealed products after delivery that cannot be returned for hygiene reasons (non-limiting example: underwear,
  • products manufactured to Customer’s specifications or clearly customized (brands, marking, specific embroidery for clothing, bags, saddlebags, belts or other related products; Sabre,Shinken, Iaito, for which the customer will have made a choice such as length of blade, tsuka (handle), same (“skin” on handle for holding hands), tsuka ito (handle braiding straps), or other choice of sword customization and related products)
  • Audio or video recordings when unsealed by the customer (i.e. when the blister has been opened, removed or torn, such as CDs and DVDs).
  • Products that are likely to deteriorate or expire quickly, (such as incense, or care sets, especially uchiko).
  • Books if damaged, torn, horned...
  • The products removed from stock will not be taken back or exchanged; except in case of hidden defects of article 12 of these GTC.

In case of exercise of the right of withdrawal, the products must be returned properly protected, in their original packaging (even unsealed), in a perfect state of resale (not damaged, not damaged, not soiled or not washed by the customer), accompanied by the above-mentioned form duly completed by the customer.
The customer is advised that he may only perform on the products for which he exercises his right of withdrawal the manipulations necessary to verify the nature, characteristics and proper functioning of the products, in application of article L.221-23 of the Consumer Code. Any manipulation of a product that goes beyond those above, resulting in the impossibility for the Customer to use its right of withdrawal of said product.
The exercise of the right of withdrawal gives rise to a refund of the amounts paid when ordering (including delivery costs) as soon as possible and no later than 14 days from the date of receipt of the products by our after-sales service. The refund will be made according to the payment methods used during the online purchase. The costs of returning your order for which you exercise your right of withdrawal will be at your sole expense.

Article 15 - Customs Duty

Any order placed on the Site and delivered outside of the European Union may be subject to possible taxes and customs duties that are imposed when the package arrives at its destination. These customs duties and any taxes related to the delivery of a product are your responsibility. To find out, we advise you to contact the competent authorities in your country.

Article 16 - Intellectual Property

  • 16.1 - All texts, comments, works, illustrations and images reproduced on this Website are reserved for copyright as well as intellectual property and worldwide. As such, and in accordance with the provisions of the intellectual property code, only use for private purposes is permitted, subject to different or even more restrictive provisions of the intellectual property code. Any reproduction of the entire or partial content of masamune-store.com is strictly prohibited, subject to legal action.

  • 16.2 - Certain products such as books, CDs and DVDs are subject to personal and specific rights of use regulating copies, public distribution, rental. You must comply with the general conditions of sale of these products, and MASAMUNE cannot be held responsible for any use that may be made of the products.

  • 16.3 - Authorized use
    The Website and the information published therein are reserved for consultation of the information through the Publisher’s data processing system.
    The User is permitted to quotes analyses and reproduction exclusively intended for the promotion of the site, in particular through magazines and press articles, subject to quoting the MASAMUNE Website as an editorial source.

    Those who wish to make such use of the Website and the information contained therein are requested to contact MASAMUNE for your courtesy. The creation of links pointing exclusively to the home page of the Site is tolerated. In any case, the Publisher reserves the right to terminate this tolerance at any time if it appears that the link established with the Site is likely to harm the interests of the latter.

  • 16.4 - Fraudulent behaviour
    Any user who acts in a way that violates this Legal Information is liable to civil or criminal prosecution, which would in particular penalise infringements of copyright and database producers' rights.
    Users are reminded that the Criminal Code (article 323-1 and following) punishes with penalties of up to five years' imprisonment and a fine of €75,000, in particular:
    - access and fraudulent maintenance in an automated data processing system,
    - the fraudulent deletion, modification or addition of data in this system,
    - the obstruction of this system.
    Criminal proceedings may be initiated by the Publisher against the User who does not comply with these provisions.

    Article 17 - Partial Invalidity

    If one or more stipulations of these GTC are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain their full force and effect.

    Article 18 - Applicable Law - Disputes

    This contract is subject to French law. The language of this contract is French. In case of dispute, the courts located in the city of Paris will be the only competent.
    In application of article L.111-1 of the Consumer Code, the Customer is informed that he can, in case of dispute in a commercial transaction, use a mediator of consumption

    Article 19 - Personal Information

    Your information and data are necessary for the management of your order and our commercial relations. In accordance with the law on data processing and freedoms of 6 January 1978, you have a right to access and correct your personal data.
